I. Scope of application
Welcome to Games Ground. Games Ground is an innovative and open event for the gaming industry. These General Terms and Conditions ("GTC") apply to contracts for the sale of admission tickets/tickets between Games Ground GmbH ("Games Ground" or "Us") and the purchasers of tickets (hereinafter "Visitors") as well as to the attendance of the Games Ground event ("Event") by the Visitors. Deviations from these GTC are only effective if they have been confirmed by Us in writing.
II. Subject matter of the contract and conclusion of the contract
The subject of these GTC is the sale of tickets and the visit of the Event.
The visitor submits a binding offer by sending his order. The contract is concluded when Games Ground initiates the debiting of the amount due for the ticket. The visitor waives the receipt of the acceptance.
The visitor pays the amount specified in his order by credit card, by PayPal, Google Pay or by bank transfer. Fulfillment occurs in any case only with credit on the account of Games Ground.
The visitor will receive an e-mail from Games Ground with the ticket for self-printing and as a mobile ticket (Passbook/Wallet App). Access to the event is granted exclusively with this ticket for self-printing or mobile ticket. Purchased tickets will not be taken back.
The resale of tickets to the event for commercial and/or business purposes by unauthorized third parties is prohibited without the written consent of Games Ground. This prohibition also applies to commercial and/or commercial brokerage and/or proxy activities (including covertly) not authorized by Games Ground.
III. Event
Games Ground organizes an innovative festival for the exchange between all participants of the gaming scene.
Games Ground can cancel the event at any time before its start without giving any reason. The event can be cancelled in particular due to official orders or other reasons not originating in the sphere of Games Ground. In all other respects, the statutory provisions apply.
Games Ground may postpone events at any time prior to their commencement without stating reasons. However, the visitor has the right to withdraw from the event if it is postponed.
Games Ground reserves the right to make program changes regarding the event at any time, which are reasonable for the visitor considering the interests of Games Ground. Cancellations, disruptive events or bottlenecks in the supply are to be accepted as long as the formative character and scope of the event is basically maintained.
Games Ground is entitled to require the visitor to wear an FFP-2 mask in the entire event area in accordance with the official orders or legal regulations applicable at the time of the event.
Games Ground is entitled to register visitors entering the event area in accordance with the official orders or legal regulations in force at the time of the event in order to enable contact tracing in the event of a subsequently identified COVID-19 case among visitors.
Excluded from attending the event are
a. persons with contact to COVID-19 cases within the last 14 days.
b. Persons with acute, non-specific general symptoms and respiratory symptoms of any severity.
c. who are under quarantine.
Games Ground is entitled to allow a visitor to attend the event only if the visitor has appropriate proof of a negative result of a COVID-19 test, a complete vaccination against COVID-19 or the existence of a previous infection with the coronavirus SARS -CoV-2, in accordance with the official orders or legal regulations in force at the time of the event.
The above regulations apply mutatis mutandis to all other pandemic/endemic cases or other viral diseases.
Visitors who are excluded from attending the event for the above reasons remain obliged to pay the ticket price and are therefore not entitled to a refund of the ticket price paid. Further claims are excluded.
In order to ensure compliance with the officially prescribed protection and hygiene measures, Games Ground is entitled to restrict the number of persons in the entire event area or in parts thereof. Games Ground may therefore temporarily deny visitors access to the entire event area or parts thereof. If a visitor who enters the event area on an event day in order to visit the event is not allowed to visit at least part of an event area on that day due to the aforementioned restrictions, the visitor may demand reimbursement of the pro-rata ticket price in the case of a multi-day ticket and reimbursement of the entire ticket price in the case of a one-day ticket, in which case the visitor will lose his right to visit the event on another day with his one-day ticket. Further claims are excluded.
IV. Prices, payment, withdrawal
The ticket price displayed on the website for the ticket generally includes the fixed admission price for the event plus any platform fees of any service providers involved in the ticket creation or booking process. The total price of the order is due for payment immediately.
Cancellation policy for consumers
A right of withdrawal for consumers does not exist for the following contracts:
Contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, transportation of goods, motor vehicle rental, delivery of food and beverages, as well as for the provision of other services related to leisure activities, if the contract provides for a specific date or period for the provision (Section 312g (2) Sentence 1 No. 9 BGB). This means that insofar as Games Ground offers services from the area of leisure activities, in particular tickets for event performances that take place at a specific time, there is no right of withdrawal.
The following applies to all other contracts for tickets:
If the visitor is a consumer as defined by § 13 BGB (German Civil Code), he can revoke his declaration of intent to conclude the contract within 14 days without stating reasons by using the revocation form or by making an express declaration (e.g. letter, e-mail, fax) to Games Ground. In order to meet the deadline, it is sufficient to send the revocation form or to submit the revocation declaration to Games Ground in due time. The revocation period begins with the conclusion of the contract, but not before Games Ground has informed the consumer in accordance with the legal requirements (§ 312 j para. 2 BGB in conjunction with Art. 246a § 1 para. 1 sentence 1 no. 1, 4, 5, 11 and 12 EGBGB).
The revocation is only possible within the revocation period up to the point in time at which the ticket loses its validity, i.e. at the end of the opening hours on the last day of the trade fair.

Consequences of revocation
If the right of revocation is effectively exercised, the tickets in question will be blocked so that access to the event is not possible.
In the event of an effective revocation, Games Ground will refund the ticket price already paid by the consumer immediately, but no later than after 14 days.
The period begins for the consumer with the sending of the revocation form or with the other submission of the revocation declaration, for Games Ground with the receipt.
Games Ground is free to choose the means of repayment for the ticket price already paid. A fee at the expense of the consumer does not arise.
V. Force majeure
If Games Ground is forced, as a result of force majeure or for other reasons for which it is not responsible, to temporarily or also for a longer period of time clear one or more parts of the event or to postpone or shorten the event, the visitor shall not be entitled to any rights of withdrawal, termination or reduction or any claims, in particular claims for damages against Games Ground. The same applies if the visitor cannot participate in the event due to force majeure or other reasons for which Games Ground is not responsible.
VI. Liability
Games Ground is liable for damages according to the statutory provisions for injury to life, body or health and for damages according to the Product Liability Act.
Games Ground is liable for other damages exclusively in accordance with the following conditions: (a) Games Ground is liable in accordance with the statutory provisions (aa) for damages caused by fraudulent conduct; (bb) for damages caused by intent or gross negligence on the part of the legal representatives or executive employees of Games Ground. (b) Games Ground is liable for damages limited to the amount of the foreseeable damage, the occurrence of which could typically be expected in the case of contracts of the present type (aa) for damages resulting from a slightly negligent breach of material contractual obligations; (bb) for damages caused by simple vicarious agents of Games Ground due to gross negligence or intent without breach of material contractual obligations.
An essential contractual obligation in the aforementioned sense is an obligation of Games Ground that is essential for the achievement of the purpose of the contract or the fulfillment of which enables the proper execution of the contract in the first place and on the compliance with which the visitor may regularly rely.
In all other respects, any liability is excluded.
VII. Data protection
Games Ground processes personal data of the visitors in accordance with the data protection information.
VIII. Changes
Games Ground reserves the right, at its sole discretion, to modify or replace the T&C.
Changes will be announced by e-mail and/or on the website. Changes do not apply retroactively. Participation in the event, despite changes and entry into force of the new GTC, also constitutes an implied declaration of consent of the visitor with regard to the respective changes. If there is no agreement regarding the changed GTC, the visitor can withdraw from the contractual relationship regarding the event if the changes are serious. Any costs incurred shall be compensated in accordance with the interests of the visitor.
IX. Final provisions
The language available for the conclusion of the contract is German.
The place of jurisdiction for all disputes arising from the contract is Berlin, provided that the visitor is a merchant, a legal entity under public law or a special fund under public law.
The law of the Federal Republic of Germany shall apply. The application of UN sales law is expressly excluded.
Should individual provisions of the contract be invalid in whole or in part, this shall not affect the validity of the remainder of the contract. The invalid provision shall then be replaced by a provision that comes as close as possible to the economic objective of the invalid provision; if this is not possible, the law shall apply.
Games Ground GmbH - General Terms and Conditions for Events - Status: 15.08.2023
I. Geltungsbereich
Willkommen bei Games Ground. Games Ground ist eine innovative und offene Veranstaltung für die Gaming-Branche. Diese Allgemeinen Geschäftsbedingungen („AGB“) gelten für Verträge über den Verkauf von Eintrittskarten/Tickets zwischen der Games Ground GmbH („Games Ground“ oder „Uns“) und den Erwerbern von Tickets (nachfolgend „Besucher“) sowie für den Besuch des Games Ground Events („Event“) durch die Besucher. Abweichungen von diesen AGB sind nur wirksam, wenn sie von Uns schriftlich bestätigt worden sind.
II. Vertragsgegenstand und Vertragsschluss
Gegenstand dieser AGB ist der Verkauf von Tickets und der Besuch des Events.
Der Besucher gibt mit Absendung seiner Bestellung ein verbindliches Angebot ab. Der Vertrag kommt zustande, wenn Games Ground die Abbuchung des für das Ticket fälligen Betrages veranlasst. Der Besucher verzichtet auf den Zugang der Annahme.
Der Besucher leistet den in seiner Bestellung angegebenen Betrag per Kreditkarte, per PayPal, Google Pay oder per Überweisung. Erfüllung tritt in jedem Fall erst mit Gutschrift auf dem Konto der Games Ground ein.
Der Besucher erhält von Games Ground eine E-Mail mit dem Ticket zum Selbstausdruck sowie als Mobile Ticket (Passbook/Wallet App). Der Zutritt zum Event erfolgt ausschließlich mit diesem Ticket zum Selbstausdruck oder Mobile Ticket. Gekaufte Tickets werden grundsätzlich nicht zurückgenommen.
Der Weiterverkauf von Tickets zum Event zu gewerblichen und/oder kommerziellen Zwecken durch nicht autorisierte Dritte ist ohne die schriftliche Zustimmung von Games Ground untersagt. Dieses Verbot gilt ebenfalls für nicht von Games Ground autorisierte kommerzielle und/oder gewerbliche Vermittlungs- und/oder Stellvertretungstätigkeiten (auch verdeckt).
III. Event
Games Ground organisiert ein innovatives Festival zum Austausch zwischen sämtlichen Beteiligten der Gaming-Szene.
Games Ground kann das Event vor dessen Beginn jederzeit und ohne Angabe von Gründen absagen. Das Event kann insbesondere aufgrund behördlicher Anordnungen oder anderen nicht in der Sphäre von Games Ground stammenden Gründen abgesagt werden. Im Übrigen gelten die gesetzlichen Bestimmungen.
Games Ground kann Veranstaltungen vor deren Beginn jederzeit und ohne Angabe von Gründen verschieben. Der Besucher erhält bei Verschiebung des Events jedoch ein Rücktrittsrecht.
Games Ground behält sich Programmänderungen bezüglich des Events jederzeit vor, die für den Besucher unter Berücksichtigung der Interessen von Games Ground zumutbar sind. Ausfälle, störende Ereignisse oder Engpässe in der Versorgung sind hinzunehmen, so lange der prägende Charakter und der Umfang der Veranstaltung grundsätzlich gewahrt bleibt.
Games Ground ist berechtigt, vom Besucher gemäß den zum Zeitpunkt des Events geltenden behördlichen Anordnungen bzw. gesetzlichen Vorschriften zu verlangen, dass er im gesamten Veranstaltungsbereich eine FFP-2 Maske trägt.
Games Ground ist berechtigt, die Besucher, die den Veranstaltungsbereich betreten, gemäß den zum Zeitpunkt der Veranstaltung geltenden behördlichen Anordnungen bzw. gesetzlichen Vorschriften zu registrieren, um eine Kontaktpersonenermittlung im Falle eines nachträglich identifizierten COVID-19-Falles unter Besuchern zu ermöglichen.
Vom Besuch des Events ausgeschlossen sind
a. Personen mit Kontakt zu COVID-19 Fällen innerhalb der letzten 14 Tage
b. Personen mit akuten, unspezifischen Allgemeinsymptomen und respiratorischen Symptomen jedweder Schwere
c. unter Quarantäne stehende Personen
Games Ground ist berechtigt, einem Besucher den Besuch des Events nur dann zu gestatten, wenn der Besucher gemäß den zum Zeitpunkt des Events geltenden behördlichen Anordnungen bzw. gesetzlichen Vorschriften entsprechende Nachweise über ein negatives Ergebnis eines COVID-19-Tests, eine vollständige Impfung gegen COVID-19 bzw. das Vorliegen einer vorherigen Infektion mit dem Coronavirus SARS -CoV-2 vorliegt.
Vorstehende Regelungen gelten sinngemäß für sämtliche anderen Pandemie-/Endemiefälle oder sonstige Viruserkrankungen.
Besucher, die aus den vorliegenden Gründen vom Besuch des Events ausgeschlossen sind, bleiben zur Zahlung des Ticketpreises verpflichtet und haben deshalb keinen Anspruch auf Erstattung des gezahlten Ticketpreises. Weitergehende Ansprüche sind ausgeschlossen.
Um die Einhaltung der behördlich vorgeschriebenen Schutz- und Hygienemaßnahmen zu gewährleisten, ist Games Ground berechtigt, die Anzahl der Personen im gesamten Eventbereich oder in Teilen davon zu beschränken. Games Ground kann deshalb Besuchern den Zutritt zum gesamten Eventbereich oder zu Teilen davon zeitweilig verwehren. Wenn ein Besucher, der an einem Eventtag das Eventgelände betritt, um das Event zu besuchen, an diesem Tag wegen vorgenannter Beschränkungen nicht zumindest einen Teil eines Eventbereichs besuchen darf, kann der Besucher bei einem Mehrtagesticket die Erstattung des anteiligen Ticketpreises und bei einem Tagesticket die Erstattung des gesamten Ticketpreises verlangen, wobei der Besucher dann sein Recht verliert, mit seinem Tagesticket das Event an einem anderen Tag zu besuchen. Weitergehende Ansprüche sind ausgeschlossen.
IV. Preise, Zahlung, Rücktritt
Der auf der Webseite angezeigte Ticketpreis für das Ticket enthält in der Regel den festgesetzten Eintrittspreis für das Event zuzüglich etwaiger Plattformgebühren etwaiger im Rahmen der Ticketerstellung oder des Buchungsprozesses eingebundener Dienstleister. Der Gesamtpreis der Bestellung ist sofort zur Zahlung fällig.
Widerrufsbelehrung für Verbraucher
Ein Widerrufsrecht für Verbraucher besteht nicht bei folgenden Verträgen:
Verträge zur Erbringung von Dienstleistungen in den Bereichen Beherbergung zu anderen Zwecken als zu Wohnzwecken, Beförderung von Waren, Kraftfahrzeugvermietung, Lieferung von Speisen und Getränken sowie zur Erbringung weiterer Dienstleistungen im Zusammenhang mit Freizeitbetätigungen, wenn der Vertrag für die Erbringung einen spezifischen Termin oder Zeitraum vorsieht (§ 312g Abs. 2 Satz 1 Nr. 9 BGB). Das heißt, soweit Games Ground Dienstleistungen aus dem Bereich der Freizeitbetätigung anbietet, insbesondere Tickets für Veranstaltungsevents, die zu einem spezifischen Zeitpunkt stattfinden, besteht kein Widerrufsrecht.
Für alle anderen Verträge über Tickets gilt:
Handelt es sich bei dem Besucher um einen Verbraucher i. S. d. § 13 BGB, kann er seine auf Abschluss des Vertrages gerichtete Willenserklärung innerhalb von 14 Tagen ohne Angabe von Gründen unter Benutzung des Widerrufsformulars oder durch ausdrückliche Erklärung (z. B. Brief, E-Mail, Fax) gegenüber Games Ground widerrufen. Zur Fristwahrung genügt das rechtzeitige Absenden des Widerrufsformulars oder die rechtzeitige Abgabe der Widerrufserklärung gegenüber Games Ground. Der Lauf der Widerrufsfrist beginnt mit Vertragsschluss, jedoch nicht vor Unterrichtung des Verbrauchers gem. den gesetzlichen Anforderungen durch Games Ground (§ 312 j Abs. 2 BGB i. V. m. Art. 246a § 1 Abs. 1 S. 1 Nr. 1, 4, 5, 11 und 12 EGBGB).
Der Widerruf ist innerhalb der Widerrufsfrist nur bis zu dem Zeitpunkt möglich, in dem das Ticket die Gültigkeit verliert, d. h. mit Ende der Öffnungszeiten am letzten Messetag.

Folgen des Widerrufs
Bei wirksamer Ausübung des Widerrufsrechts werden die betreffenden Tickets gesperrt, sodass der Zutritt zum Event nicht möglich ist.
Im Falle eines wirksamen Widerrufs zahlt Games Ground den bereits durch den Verbraucher entrichteten Ticketpreis unverzüglich, aber spätestens nach 14 Tagen, zurück.
Die Frist beginnt für den Verbraucher mit Absenden des Widerrufsformulars oder mit der sonstigen Abgabe der Widerrufserklärung, für Games Ground mit dem Empfang.
Bei der Rückzahlung des schon geleisteten Ticketpreises ist Games Ground in der Wahl des Rückzahlungsmittels frei. Eine Gebühr zu Lasten des Verbrauchers entsteht nicht.
V. Höhere Gewalt
Ist Games Ground infolge höherer Gewalt oder aus anderen von ihr nicht zu vertretenden Gründen genötigt, einen oder mehrere Teile des Events vorübergehend oder auch für längere Dauer zu räumen oder das Event zu verschieben oder zu verkürzen, so erwachsen dem Besucher hieraus weder Rücktritts-, Kündigungs- bzw. Minderungsrechte noch irgendwelche Ansprüche, insbesondere Schadensersatzansprüche gegen Games Ground. Gleiches gilt, wenn der Besucher infolge höherer Gewalt oder aus anderen von Games Ground nicht zu vertretenden Gründen nicht an dem Event teilnehmen kann.
VI. Haftung
Games Ground haftet auf Schadenersatz nach den gesetzlichen Bestimmungen für die Verletzung von Leben, Körper oder Gesundheit und für Schäden nach dem Produkthaftungsgesetz.
Games Ground haftet für sonstige Schäden ausschließlich nach den folgenden Bedingungen: (a) Games Ground haftet nach den gesetzlichen Bestimmungen (aa) für Schäden, die durch arglistiges Verhalten verursacht wurden; (bb) für Schäden, die durch Vorsatz oder grobe Fahrlässigkeit der gesetzlichen Vertreter oder leitenden Angestellten von Games Ground verursacht wurden. (b) Games Ground haftet auf Schadenersatz begrenzt auf die Höhe des vorhersehbaren Schadens, mit dessen Eintritt bei Verträgen der vorliegenden Art typischerweise gerechnet werden musste (aa) für Schäden aus einer leicht fahrlässigen Verletzung vertragswesentlicher Pflichten; (bb) für Schäden, die von einfachen Erfüllungsgehilfen von Games Ground grob fahrlässig oder vorsätzlich ohne Verletzung vertragswesentlicher Pflichten verursacht wurden.
Als vertragswesentliche Pflicht im vorgenannten Sinn ist eine solche Pflicht von Games Ground zu verstehen, die für die Erreichung des Vertragszwecks wesentlich ist oder deren Erfüllung die ordnungsgemäße Durchführung des Vertrags erst ermöglicht und auf deren Einhaltung der Besucher regelmäßig vertrauen darf.
Im Übrigen ist jegliche Haftung ausgeschlossen.
VII. Datenschutz
Games Ground verarbeitet persönliche Daten der Besucher gemäß den Datenschutzhinweisen.
VIII. Änderungen
Games Ground behält sich das Recht vor, nach eigenem Ermessen die AGB zu ändern oder zu ersetzen.
Änderungen werden mittels E-Mail und/oder auf der Webseite bekanntgegeben. Änderungen gelten nicht rückwirkend. Die Teilnahme an dem Event, trotz Änderung und Inkrafttreten der neuen AGB, stellt zugleich eine konkludente Einverständniserklärung des Besuchers bezüglich der jeweiligen Änderungen dar. Sollte kein Einverständnis bzgl. der geänderten AGB bestehen, so kann der Besucher vom Vertragsverhältnis bezüglich der Veranstaltung zurücktreten, wenn die Änderungen gravierend sind. Anfallende Kosten sind hierbei interessengerecht abzugelten.
IX. Schlussbestimmungen
Die für den Vertragsschluss zur Verfügung stehende Sprache ist Deutsch.
Gerichtsstand für alle Streitigkeiten aus dem Vertrag ist Berlin, sofern der Besucher Kaufmann, eine juristische Person des öffentlichen Rechts oder ein öffentlich-rechtliches Sondervermögen ist.
Es gilt das Recht der Bundesrepublik Deutschland. Die Anwendung von UN-Kaufrecht wird ausdrücklich ausgeschlossen.
Sollten einzelne Bestimmungen des Vertrags ganz oder teilweise unwirksam sein, wird hiervon die Wirksamkeit des Vertrages im Übrigen nicht berührt. Die unwirksame Bestimmung soll dann durch eine Regelung ersetzt werden, die der wirtschaftlichen Zielsetzung der unwirksamen Bestimmung möglichst nahe kommt; ist dies nicht möglich, gilt das Gesetz.
