I. Scope of application

Welcome to Games Ground. Games Ground is an innovative and open event for the gaming industry. These General Terms and Conditions ("GTC") apply to contracts for the sale of admission tickets/tickets between Games Ground GmbH ("Games Ground" or "Us") and the purchasers of tickets (hereinafter "Visitors") as well as to the attendance of the Games Ground event ("Event") by the Visitors. Deviations from these GTC are only effective if they have been confirmed by Us in writing.

II. Subject matter of the contract and conclusion of the contract

1. The subject of these GTC is the sale of tickets and the visit of the Event.

2. The visitor submits a binding offer by sending his order. The contract is concluded when Games Ground initiates the debiting of the amount due for the ticket.

3. The visitor waives the receipt of the acceptance.The visitor pays the amount specified in his order by credit card, by PayPal, Google Pay or by bank transfer. Fulfillment occurs in any case only with credit on the account of Games Ground.

4. The visitor will receive an e-mail from Games Ground with the ticket for self-printing and as a mobile ticket (Passbook/Wallet App). Access to the event is granted exclusively with this ticket for self-printing or mobile ticket. Purchased tickets will not be taken back.

5. The resale of tickets to the event for commercial and/or business purposes by unauthorized third parties is prohibited without the written consent of Games Ground. This prohibition also applies to commercial and/or commercial brokerage and/or proxy activities (including covertly) not authorized by Games Ground.

III. Event

1. Games Ground organizes an innovative festival for the exchange between all participants of the gaming scene.

2. Games Ground can cancel the event at any time before its start without giving any reason. The event can be cancelled in particular due to official orders or other reasons not originating in the sphere of Games Ground. In all other respects, the statutory provisions apply.

3. Games Ground may postpone events at any time prior to their commencement without stating reasons. However, the visitor has the right to withdraw from the event if it is postponed.

4. Games Ground reserves the right to make program changes regarding the event at any time, which are reasonable for the visitor considering the interests of Games Ground. Cancellations, disruptive events or bottlenecks in the supply are to be accepted as long as the formative character and scope of the event is basically maintained.

5. Games Ground is entitled to require the visitor to wear an FFP-2 mask in the entire event area in accordance with the official orders or legal regulations applicable at the time of the event.

6. Games Ground is entitled to register visitors entering the event area in accordance with the official orders or legal regulations in force at the time of the event in order to enable contact tracing in the event of a subsequently identified COVID-19 case among visitors.

7. Excluded from attending the event are
a. persons with contact to COVID-19 cases within the last 14 days.
b. Persons with acute, non-specific general symptoms and respiratory symptoms of any severity.
c. who are under quarantine.

8. Games Ground is entitled to allow a visitor to attend the event only if the visitor has appropriate proof of a negative result of a COVID-19 test, a complete vaccination against COVID-19 or the existence of a previous infection with the coronavirus SARS -CoV-2, in accordance with the official orders or legal regulations in force at the time of the event.

9. The above regulations apply mutatis mutandis to all other pandemic/endemic cases or other viral diseases.

10. Visitors who are excluded from attending the event for the above reasons remain obliged to pay the ticket price and are therefore not entitled to a refund of the ticket price paid. Further claims are excluded.

11. In order to ensure compliance with the officially prescribed protection and hygiene measures, Games Ground is entitled to restrict the number of persons in the entire event area or in parts thereof. Games Ground may therefore temporarily deny visitors access to the entire event area or parts thereof. If a visitor who enters the event area on an event day in order to visit the event is not allowed to visit at least part of an event area on that day due to the aforementioned restrictions, the visitor may demand reimbursement of the pro-rata ticket price in the case of a multi-day ticket and reimbursement of the entire ticket price in the case of a one-day ticket, in which case the visitor will lose his right to visit the event on another day with his one-day ticket. Further claims are excluded.

IV. Prices, payment, withdrawal

1. The ticket price displayed on the website for the ticket generally includes the fixed admission price for the event plus any platform fees of any service providers involved in the ticket creation or booking process. The total price of the order is due for payment immediately.

2. Cancellation policy for consumers

A right of withdrawal for consumers does not exist for the following contracts:

Contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, transportation of goods, motor vehicle rental, delivery of food and beverages, as well as for the provision of other services related to leisure activities, if the contract provides for a specific date or period for the provision (Section 312g (2) Sentence 1 No. 9 BGB). This means that insofar as Games Ground offers services from the area of leisure activities, in particular tickets for event performances that take place at a specific time, there is no right of withdrawal.

The following applies to all other contracts for tickets:
If the visitor is a consumer as defined by § 13 BGB (German Civil Code), he can revoke his declaration of intent to conclude the contract within 14 days without stating reasons by using the revocation form or by making an express declaration (e.g. letter, e-mail, fax) to Games Ground. In order to meet the deadline, it is sufficient to send the revocation form or to submit the revocation declaration to Games Ground in due time. The revocation period begins with the conclusion of the contract, but not before Games Ground has informed the consumer in accordance with the legal requirements (§ 312 j para. 2 BGB in conjunction with Art. 246a § 1 para. 1 sentence 1 no. 1, 4, 5, 11 and 12 EGBGB).

The revocation is only possible within the revocation period up to the point in time at which the ticket loses its validity, i.e. at the end of the opening hours on the last day of the trade fair.

Consequences of revocation

If the right of revocation is effectively exercised, the tickets in question will be blocked so that access to the event is not possible.

In the event of an effective revocation, Games Ground will refund the ticket price already paid by the consumer immediately, but no later than after 14 days.

The period begins for the consumer with the sending of the revocation form or with the other submission of the revocation declaration, for Games Ground with the receipt.

Games Ground is free to choose the means of repayment for the ticket price already paid. A fee at the expense of the consumer does not arise.

V. Force majeure

If Games Ground is forced, as a result of force majeure or for other reasons for which it is not responsible, to temporarily or also for a longer period of time clear one or more parts of the event or to postpone or shorten the event, the visitor shall not be entitled to any rights of withdrawal, termination or reduction or any claims, in particular claims for damages against Games Ground. The same applies if the visitor cannot participate in the event due to force majeure or other reasons for which Games Ground is not responsible.

VI. Force majeure

1. Games Ground is liable for damages according to the statutory provisions for injury to life, body or health and for damages according to the Product Liability Act.

2. Games Ground is liable for other damages exclusively in accordance with the following conditions: (a) Games Ground is liable in accordance with the statutory provisions (aa) for damages caused by fraudulent conduct; (bb) for damages caused by intent or gross negligence on the part of the legal representatives or executive employees of Games Ground. (b) Games Ground is liable for damages limited to the amount of the foreseeable damage, the occurrence of which could typically be expected in the case of contracts of the present type (aa) for damages resulting from a slightly negligent breach of material contractual obligations; (bb) for damages caused by simple vicarious agents of Games Ground due to gross negligence or intent without breach of material contractual obligations.

3. An essential contractual obligation in the aforementioned sense is an obligation of Games Ground that is essential for the achievement of the purpose of the contract or the fulfillment of which enables the proper execution of the contract in the first place and on the compliance with which the visitor may regularly rely.

4. In all other respects, any liability is excluded.

VII. Data protection

Games Ground processes personal data of the visitors in accordance with the data protection information.

VIII. Changes

1. Games Ground reserves the right, at its sole discretion, to modify or replace the T&C.

2. Changes will be announced by e-mail and/or on the website. Changes do not apply retroactively. Participation in the event, despite changes and entry into force of the new GTC, also constitutes an implied declaration of consent of the visitor with regard to the respective changes. If there is no agreement regarding the changed GTC, the visitor can withdraw from the contractual relationship regarding the event if the changes are serious. Any costs incurred shall be compensated in accordance with the interests of the visitor.

IX. Final provisions

1. The language available for the conclusion of the contract is German.

2. The place of jurisdiction for all disputes arising from the contract is Berlin, provided that the visitor is a merchant, a legal entity under public law or a special fund under public law.

3. The law of the Federal Republic of Germany shall apply. The application of UN sales law is expressly excluded.

4. Should individual provisions of the contract be invalid in whole or in part, this shall not affect the validity of the remainder of the contract. The invalid provision shall then be replaced by a provision that comes as close as possible to the economic objective of the invalid provision; if this is not possible, the law shall apply.
